Terms of Use

These terms set the rules for using the NearDoctor patient app (NearDoctor), the doctor app (NearDoctor Médico) and the website neardoctor.pt. By creating an account or using the apps, you accept them. Our Privacy Policy explains how we handle personal data.

1. Who we are

NearDoctor is operated by [RAZÃO SOCIAL / COMPANY LEGAL NAME], NIF [NIF], with registered address at [MORADA DA SEDE / REGISTERED ADDRESS], registered at [CONSERVATÓRIA E N.º DE MATRÍCULA / COMMERCIAL REGISTRY], with a share capital of [CAPITAL SOCIAL / SHARE CAPITAL]. [TO BE CONFIRMED BY COUNSEL] Contact: suporte@neardoctor.pt.

2. What NearDoctor is, and what it isn't

  • NearDoctor is an intermediary platform. Patients use it to request home visits (consultas ao domicílio) from nearby doctors and to pay for them; doctors use it to receive these requests and to get paid.
  • NearDoctor does not provide medical care. The doctors are independent professionals registered with the Ordem dos Médicos. They are not NearDoctor employees, and they alone are responsible for the medical care they provide, including diagnosis, treatment, prescriptions and clinical records.
  • The medical service is provided by the doctor to the patient. [TO BE CONFIRMED BY COUNSEL]

3. Not for emergencies

NearDoctor is not an emergency service. In an emergency (for example, if someone is unconscious, has severe chest pain or difficulty breathing, heavy bleeding or signs of a stroke), call 112 immediately.

Before every request, the patient app asks a few safety questions. If you report any of these warning signs, the request is stopped and you are told to call 112. We cannot guarantee that a doctor will accept a request, or that a doctor will arrive within a given time.

4. Your account

  • You must be at least 18 years old to create an account.
  • Give accurate information and keep it up to date.
  • Keep your password secret. You are responsible for what happens on your account; tell us straight away at suporte@neardoctor.pt if you think someone else has used it.
  • Before you can request a visit, we may ask you to verify your mobile number and to add a profile photo.
  • Accounts are personal and cannot be transferred.
  • If you request a visit for someone else (for example, a family member), you must be entitled to act on their behalf and to share their information with us and with the doctor. [TO BE CONFIRMED BY COUNSEL]

5. How a visit works

  • You choose an urgent visit (as soon as possible) or a scheduled visit (a date and time window), confirm the address, describe the symptoms and set the maximum price you are willing to pay.
  • Your request goes to verified doctors who are available, offer that type of visit, work in the area and whose price is within the maximum you set. The first doctor to accept it is assigned to your visit.
  • If no doctor accepts it within a set time (currently 15 minutes), the request expires and the payment hold is released in full.
  • Once a doctor accepts, you can follow the doctor's location in the app until the visit ends. The doctor updates the status of the visit in the app: on the way, arrived, in progress and completed.
  • Please be at the address at the agreed time and give the doctor accurate information.
  • After the visit you can rate the doctor, and the doctor can rate you.

6. Prices and payment

  • Doctors set their own prices, within the minimum and maximum limits that NearDoctor sets for each region. Prices are in euros. [TO BE CONFIRMED BY COUNSEL]
  • When you send a request, you set the maximum price you authorise and confirm the payment through Stripe Checkout. Your card is not charged at that point: a pre-authorisation (hold) for the maximum amount is placed on it.
  • After the doctor marks the visit as completed, we charge the price of the doctor who accepted your request, as fixed when they accepted it. It is never more than the maximum you authorised, and you are never charged the difference: the rest of the hold is released. How quickly it disappears from your statement depends on your bank.
  • NearDoctor's commission is paid by the doctor: it is deducted from the amount of the visit, not added to your price (section 8).
  • NearDoctor collects the payment through Stripe and transfers the doctor's share to the doctor. [TO BE CONFIRMED BY COUNSEL]
  • The invoice or receipt for the visit is issued by [EMITENTE DA FATURA / INVOICE ISSUER]. [TO BE CONFIRMED BY COUNSEL]
  • Card payments are processed by Stripe. NearDoctor never sees your full card number.
  • If you think a charge is wrong, contact us at suporte@neardoctor.pt. When a refund is due, it is made to the card you paid with.

7. Cancellations

  • Before a doctor accepts your request, you can cancel free of charge. The hold is released in full.
  • After a doctor accepts (including when the doctor is on the way, has arrived or the visit is in progress), you can still cancel, but a cancellation fee applies. The fee is set by NearDoctor (currently €10 by default, and it may vary by region) and is never more than the maximum you authorised. The fee is charged to your card and the rest of the hold is released. It compensates the doctor for the time and travel already committed to your visit and is paid to the doctor in full. The app warns you before you confirm the cancellation. [TO BE CONFIRMED BY COUNSEL]
  • Requests that expire because no doctor accepted them are not charged.
  • Completed visits cannot be cancelled. If something went wrong, contact us.
  • If the doctor cannot come after accepting your request, contact us at suporte@neardoctor.pt. [REGRA PARA CANCELAMENTO OU FALTA DO MÉDICO / RULE FOR DOCTOR CANCELLATION OR NO-SHOW]
  • Right of withdrawal: [DIREITO DE LIVRE RESOLUÇÃO / RIGHT OF WITHDRAWAL] [TO BE CONFIRMED BY COUNSEL]

8. Doctors

This section applies to doctors who use the NearDoctor Médico app, in addition to the rest of these terms. [TO BE CONFIRMED BY COUNSEL]

  • Eligibility. You must be legally entitled to practise medicine in Portugal, with a valid registration at the Ordem dos Médicos. You give us your professional licence number, which we check before activating your account. Tell us immediately if your registration is suspended or restricted. [SEGURO DE RESPONSABILIDADE CIVIL PROFISSIONAL / PROFESSIONAL LIABILITY INSURANCE] [TO BE CONFIRMED BY COUNSEL]
  • Independence. You use NearDoctor as an independent professional, not as an employee or agent of NearDoctor. You decide when you are available, which requests you accept and your prices (within the regional limits). You are responsible for the medical care you provide, for complying with your professional and ethical duties (including medical confidentiality), for your clinical records and for your own tax and social security obligations.
  • Availability and location. When you mark yourself as available, and during a visit, the app shares your live location with NearDoctor, only while the app is in use. During an active visit, your location is shown to the patient. Your availability stays on until you turn it off. While you are available, you are notified of new requests even when the app is closed; requests are offered to you based on your work regions, the services you offer and your price.
  • Accepting requests. You are free to accept or ignore requests. When you accept one, you commit to attending the visit, keeping its status up to date in the app and marking it as completed when it ends.
  • Prices. You set a base price and, if you wish, prices for specific regions, within the minimum and maximum set by NearDoctor. After you change your base price, it stays locked for a short time (currently 30 minutes). You only receive requests whose patient authorised a maximum that covers your price, and the price shown to you is the price charged for the visit. You are not shown the patient's maximum.
  • Payment and commission. When you mark a visit as completed, the patient's payment is collected and NearDoctor keeps a commission: by default, 15% of the amount charged. The rate may vary by region and may change; we will tell you in advance ([PRAZO DE AVISO PRÉVIO / NOTICE PERIOD]). The rest is transferred to your Stripe Connect account, and Stripe pays it into your bank account according to your payout schedule. Transfers start once your Stripe account is set up; amounts from earlier visits are transferred at that point. [TO BE CONFIRMED BY COUNSEL]
  • Cancellation fees. When a patient cancels a request after you have accepted it, the cancellation fee is transferred to you in full, without any NearDoctor commission, through your Stripe Connect account on the same terms as visit payments. [TO BE CONFIRMED BY COUNSEL]
  • Stripe. Payouts are provided by Stripe and are subject to Stripe's Connected Account Agreement, which you accept when you set up your Stripe account. You authorise NearDoctor to share with Stripe the information needed for this. [TO BE CONFIRMED BY COUNSEL]
  • Patient data. Through the app you receive patients' personal data, including health data. Use it only to assess and carry out the visit, keep it confidential, and protect it as required by the GDPR and your duty of medical confidentiality. [TO BE CONFIRMED BY COUNSEL]
  • Rating patients. After a visit you can rate the patient. Ratings must be honest, relevant and respectful.

9. Rules for everyone

When using NearDoctor, you must not:

  • give false information or pretend to be someone else;
  • use NearDoctor for emergencies or for any unlawful purpose;
  • harass, threaten or discriminate against other users, or behave inappropriately during a visit;
  • use other users' data for anything other than the visit;
  • arrange to pay, or to be paid, outside the app for visits arranged through NearDoctor; [TO BE CONFIRMED BY COUNSEL]
  • write false, abusive or unlawful reviews;
  • interfere with the security or operation of the apps, or access them by automated means.

We may remove content and suspend or close accounts that break these rules (section 13). Reviews must reflect a real experience; we may remove reviews that are abusive, unlawful or unrelated to the visit. [TO BE CONFIRMED BY COUNSEL]

10. TestFlight beta

NearDoctor is currently in a beta test, distributed through Apple's TestFlight to a small group of invited people (the NearDoctor team and people we know). During the beta:

  • payments run in Stripe's test mode: no real charges are made, and you should use only the test card details we give you, never your real card;
  • features may change, may be removed or may not work as expected, and the service may be interrupted;
  • [CONDIÇÕES DAS CONSULTAS DURANTE A BETA / TERMS FOR VISITS DURING THE BETA] [TO BE CONFIRMED BY COUNSEL]
  • your use of TestFlight is also subject to Apple's terms.

Your feedback is welcome at suporte@neardoctor.pt.

11. Availability of the service

We work to keep NearDoctor available, but we cannot guarantee that the apps will always work without interruption, or that a doctor will be available in your area at a given time. We may change, suspend or discontinue features, especially during the beta.

12. Liability

  • NearDoctor is responsible for operating the platform with due care. The doctor is responsible for the medical care provided during the visit.
  • NearDoctor is not liable for the medical acts of doctors, for losses caused by a user breaking these terms, or for events beyond our reasonable control.
  • Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited (including for wilful misconduct or gross negligence, or for harm to life, health or physical integrity caused by our fault), nor does it affect your rights as a consumer. [TO BE CONFIRMED BY COUNSEL]

13. Suspension and closing your account

  • You can delete your account at any time with "Delete account" in the app. Deleting your account does not cancel amounts already due, for example for a completed visit or a cancellation fee.
  • We may suspend or close an account if the user breaks these terms or the law, if we suspect fraud, if it is needed to protect other users or, for doctors, if their professional registration is no longer valid. Where appropriate, we will tell you why and give you a chance to respond. [TO BE CONFIRMED BY COUNSEL]

14. Intellectual property

The NearDoctor apps, website, brand and content belong to NearDoctor or its licensors. While you have an account, we give you a personal, non-exclusive and non-transferable licence to use the apps for their intended purpose. You keep the rights to the content you submit, such as reviews, and allow us to display it in the service.

15. Changes to these terms

We may update these terms, for example when we change the service or the law changes. We will tell you about significant changes in the app or by email before they take effect ([PRAZO DE AVISO PRÉVIO / NOTICE PERIOD]). If you don't agree, you can delete your account before the changes take effect. [TO BE CONFIRMED BY COUNSEL]

16. Complaints, disputes and applicable law

  • If you have a complaint, write to us at suporte@neardoctor.pt and we will try to solve it quickly.
  • You can also use the electronic complaints book (Livro de Reclamações Eletrónico) at www.livroreclamacoes.pt. [TO BE CONFIRMED BY COUNSEL]
  • If you are a consumer, you can take a dispute to an alternative dispute resolution entity: [ENTIDADE DE RAL / ADR ENTITY]. More information at www.consumidor.gov.pt. [TO BE CONFIRMED BY COUNSEL]
  • These terms are governed by Portuguese law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live. [TO BE CONFIRMED BY COUNSEL]
